International conventions, the resulting obligations and the related legislative and technical development requirements

International Conventions, their related obligations and the updating requirements from the legislative and technological aspects:

Studies undertaken by the Division:

  • International legislative systems in the field of international maritime transport; the impact of multimodal transport , GATT Conventions, the needs of updating the national legislations in order to cope with the world transport traffic and the development of exports traffic. (August 2004)

Studies undertaken outside the Division:

  • The proposed Egyptian commitments towards the General Convention for Trade in Services in the field of land and maritime transport and their impacts on the policies of the Ministry of Transport.

The entity that carried out the study:

– Researches and Consultations Center affiliated to the Maritime Transport Sector-Arab Academy for Science ,Technology and Maritime Transport

The objective of the Study:

Listing all laws, regulations and decrees related to trade and transport in Egypt and also all international valid legislations in the international trade and transport region:

Results:

  • The liberalization of maritime transport services after (GATS) Convention is still under negotiation between the parties with contradicting interests
  • The Egyptian obligation to this liberation in accordance with (GATS) convention does not cope with the provisions of law number 8/1997 on investment incentives.
  • Focusing on the great importance of transit activity and cargo transport between Egypt’s different outlets.
  • Even with the existence of a strong exporting strategy, they lack of realistic and efficient mechanisms and the deformation of export industries structure.

Recommendations:

  • Review the applicable laws in the field of exporting.
  • Activating GATS convention for Egyptian exports development as follows:
    • administrative reform and ports’ updating.
    • issuing new laws related to multimodal transport and establishing new dry ports.

Proposed obligations from Egypt towards the General Convention for Trade in Services in the field of land and maritime transport and their impact on the policies of the Ministry of Transport: (June 2006):

The entity that carried out the study:

Researches and Consultations Center affiliated to the Maritime Transport Sector-Arab Academy for Science ,Technology and Maritime Transport

The objective of the Study:

The development of a complete view in front of decision makers concerning positive and negative impacts that may result from the liberalization of transport services trade for foreign importer

Recommendations:

The development of the transport sector must be related to the following:

  • First: strategic and executive strategies to coordinate the general policy of the transport sector with services liberalization strategies.
  • Second: updating several legislation to cope with international and local changes.
  • Third: developing the infra structure and transport services system.
  • Fourth: maritime transport services:
    • Taking time before providing any obligations for liberating maritime transport services until most of other countries do.
    • Studying the possibility of entering the maritime transport markets especially: maritime labor and maritime transport supporting services.
    • Following a protective strategy for the national fleet, with the necessity of renewing it.
    • Limiting port services such as pilotage, maritime agency and bunkering on national private sector.
